District Court Mysore

According to the government notification on 24th august 1873 five types of judicial officers were appointed after 1st January 1875 to maintain law and order in Mysore. Munsiffs, Commissioner, Deputy Commissioner, Judicial assistant and judicial commissioner, in which SI.No 2 to 5 has given the rights to provide judgement on different types of appeal. The changes in the designation of the judicial officers had implemented from September 15th, 1879.  Not only had the designation of the judicial officers changed, but the name of the courts as well. The court for the subordinate judge, the court for the Munsifs, The court of the judicial commissioner and the court of district judge. Different courts have been invested with different power. The district court Mysore has given the power to make a judgement for both criminal and civil cases arising within the jurisdiction of Mysore District.

Foundation and History of District Court in Mysore

The exact date of the establishment of District Court is not mentioned anywhere. It appears that according to the rule published in the notification of the Chief Commissioner in Mysore, Civil court was established in Mysore as the name of Astagrama Division. After several amendments and modification, a fresh notification No.236 and 235 were published on 27-8-1879 for the reconstitution of civil court. These notifications were published in the Mysore Gazette on 13 September 1879 and had come into action from September 15th, 1879. Therefore, it appears that the district court of Mysore came into existence on 15/09/1879.

Composition of District Court

The district court is the highest court in each district. Besides High court of the state, it is the principal court that derives its jurisdiction in civil matters primarily from the code of civil procedure. The district court is also called a session court when it provides jurisdiction on criminal matters.
The district court is controlled by “district judge” appointed by the state government. Besides district judge, assistant district judge and additional district judges are also appointed depending on the workload in court. The additional district judge has equivalent jurisdiction power as the district judge. However, the district judge has supervisory control over the assistant and additional district judge, including decisions on the distribution of power among them.

Appointment of District Judges

The district judges are appointed by the governor of the state after consultation with the chief justice of the high court of the state.  The candidate who has minimum seven years of experience practicing as a lawyer is eligible to apply for the post of district judge. Moreover, the candidate must qualify the oral and written test held by the high court judges. The appointment of the district judges is informed by the government of the state. This is also called direct recruitment. The district judge is also appointed by the way of elevation of the judges from district court and court subordinates.

Power of District Court Mysore

The district court is empowered to transfer and withdrawn appeals, suits and other proceedings pending in subordinates or other court in the district. The court has also the administrative control over the staffs of the department and subordinate courts working in the district.
